CHICK-FIL-A® BREAKFAST GIVEAWAY PROMOTION OFFICIAL RULES AND TERMS OF OFFER
SPONSOR: Chick-fil-A, Inc., 5200 Buffington Road, Atlanta, Georgia USA 30349 (“Sponsor”).

HOW TO PARTICIPATE: Eligible participants who visit a participating Chick-fil-A location from 10:30 AM until 6:00 PM on January 1, 2009 and make any purchase will receive an offer, while supplies last, redeemable for one (1) free chicken biscuit on a subsequent visit to participating Chick-fil-A locations (“Offer”). Offer is redeemable at participating Chick-fil-A locations that serve breakfast during regular breakfast hours through March 28, 2009.
ELIGIBILITY: Offer available only to legal U.S. residents of AL, AR, AZ, CA, CO, DE, FL, GA, IA, IL, IN, KS, KY, LA, MA, MD, MO, MS, NC, NH, NJ, NM, OH, OK, PA, SC, TN, TX, UT, VA, WI, WV, and WY. Limit one Offer per person, regardless of location and/or number of visits, while supplies last.
Employees and their immediate family and household members (whether or not related) of Sponsor, CFA Properties, Inc., and any Chick-fil-A, Dwarf House®, and Truett’s Grill® restaurants, and their franchised restaurant Operators, employees, affiliates, subsidiaries, advertising and promotion agencies, and all other entities or individuals associated with the development, administration, or fulfillment of this Promotion (collectively, the “Promotion Entities”) are not eligible to participate in the Promotion.
GENERAL CONDITIONS: Void where prohibited. Sponsor reserves the right, at its sole discretion, to disqualify any individual found to be tampering with the operation of the Promotion, to be acting in violation of these Official Rules, or to be acting in a non-sportsmanlike or disruptive manner, or with the intent to annoy, abuse, threaten, or harass any other person or participant. If, for any reason, the Promotion is not capable of running as planned by reason of, but not limited to, tampering, unauthorized intervention, actions by participants, fraud, or any other causes which, Sponsor, in its sole opinion, deems could corrupt or affect the administration, fairness, integrity, or proper conduct of the Promotion, or the Promotion is otherwise not capable of running as planned, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend the Promotion. If such malfunction, error, disruption, or damage occurs, and it impairs the administration, fairness, or integrity of the Promotion, Sponsor may, in its sole discretion, suspend or terminate the Promotion or any portion thereof by posting a notice at participating Chick-fil-A locations or at . In the event that a chicken biscuit or any other item, product, or service cannot be awarded for any reason, Sponsor and Promotion Entities shall not be obligated to award any item, product, or service, and Sponsor reserves the right, in its sole discretion, whether to substitute a chicken biscuit or any other item, product, or service (or any portion thereof) with an item, product, or service of comparable or greater value or cash value.
LIMITATIONS OF LIABILITY: IN NO EVENT WILL SPONSOR OR ANY PROMOTION ENTITIES BE RESPONSIBLE OR LIABLE FOR ANY INJURIES, CLAIMS, ACTIONS, DAMAGES, LOSSES, OR LIABILITY OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES RESULTING FROM OR ARISING FROM PARTICIPATION IN, OR THE PRODUCTION, PROMOTION, OR ADMINISTRATION OF THE PROMOTION, OR ACCEPTANCE, POSSESSION, USE, MISUSE, OR NONUSE OF ANY ITEM, PRODUCT, OR SERVICE THAT MAY BE AWARDED. WITHOUT LIMITING THE FOREGOING, ALL ITEMS, PRODUCTS, AND SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO PARTICIPANTS. CHECK LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS. ANY ATTEMPT BY A PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD ANY SUCH ATTEMPT BE MADE, SPONSOR AND PROMOTION ENTITIES RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
NON-WAIVER: The failure or delay by Sponsor or Promotion Entities in enforcing any particular clause, provision, or aspect of these Official Rules shall not impact the validity or enforceability, or effect of any other clause, provision, or aspect of these Official Rules.
MISCELLANEOUS: By participating in this Promotion, each participant agrees to be bound by these Official Rules and the decisions and/or interpretations of Sponsor or Promotion Entities regarding the Official Rules, which are final and binding in all respects. Non-compliance with these Official Rules may result in disqualification from the Promotion. By participating in the Promotion, each participant waives any right to claim ambiguity in these Official Rules.
VENUE AND APPLICABLE LAW: This Promotion will be administered in the State of Georgia, and by participating, all participants agree that: (a) the laws of the State of Georgia will apply exclusively to this Promotion, and (b) any dispute with respect to this Promotion will be resolved exclusively in either the federal or state courts located in the State of Georgia.
